1. Introduction

Welcome to www.everfastfreight.com. These Terms and Conditions govern your use of our Website and the freight forwarding and logistics services provided by Everfast Freight Forwarders Pvt Ltd.

By accessing this Website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services or website.

2. Definitions

"Customer" refers to the individual or entity engaging Everfast Freight for services, including shippers, consignees, and agents.

"Shipment" refers to any goods, cargo, or documents entrusted to us for transportation, storage, or handling.

"Services" refers to air freight, ocean freight, warehousing, customs brokerage, road transport, door-to-door delivery, and project forwarding services provided by us.

"Carrier" refers to any third-party airline, shipping line, or road transport operator used to transport the Shipment.

3. Scope of Services

Everfast Freight acts as an agent for the Customer in arranging transport and logistics services. While we facilitate the movement of goods, we do not physically transport the goods ourselves unless explicitly stated for specific road transport legs. We reserve the right to select independent carriers and third-party service providers to handle your Shipment.

4. Booking and Documentation

  • Accuracy: The Customer is responsible for providing accurate and complete information regarding the Shipment, including weight, dimensions, nature of goods, and value.
  • Dangerous Goods: The Customer must declare any hazardous, dangerous, or restricted materials prior to booking. We reserve the right to refuse such cargo if not properly declared or packaged in accordance with IATA/IMDG regulations.
  • Packaging: The Customer warrants that all goods are properly packed, labeled, and prepared for transport. Everfast Freight is not liable for damage caused by insufficient packaging.

5. Rates and Payments

  • Quotations: All quotations are estimates based on current rates and are subject to change without notice until a booking is confirmed. Quotations do not include customs duties, taxes, or inspection fees unless specified.
  • Payment Terms: Invoices are due upon receipt or as per the agreed credit terms. Late payments may attract interest at the prevailing commercial rates.
  • Currency: Payments must be made in the currency specified in the invoice. Any exchange rate fluctuations are the responsibility of the Customer.
  • Lien: Everfast Freight has a general lien on all goods and documents in our possession for any outstanding amounts due from the Customer.

6. Customs and Compliance

The Customer is solely responsible for ensuring that the Shipment complies with all applicable laws and regulations of the origin, transit, and destination countries.

The Customer is responsible for the payment of all duties, taxes, fines, or penalties imposed by customs or other government authorities.

Everfast Freight is not liable for delays or confiscations resulting from incorrect documentation or non-compliance by the Customer.

7. Liability and Limitations

  • Limited Liability: As a freight forwarder, our liability is limited in accordance with international conventions (such as the Warsaw Convention, Montreal Convention, or Hague-Visby Rules) and standard trading conditions.
  • Indirect Damages: Everfast Freight shall not be liable for any indirect, special, consequential, or punitive damages, including but not limited to loss of profits, loss of market, or business interruption.
  • Third-Party Actions: We are not liable for the acts, omissions, or negligence of third-party carriers, warehouse operators, or customs officials.

8. Cargo Insurance

Standard freight liability is limited by weight and often does not cover the full value of the goods. We strongly recommend that the Customer arrange for comprehensive All-Risk Cargo Insurance. Everfast Freight can arrange insurance upon written request and payment of the applicable premium.

9. Claims

Any claim for loss or damage must be notified to Everfast Freight in writing immediately upon discovery.

  • Visible Damage: Must be noted on the delivery receipt immediately upon delivery.
  • Concealed Damage: Must be reported within 7 days of delivery.
  • Non-Delivery: Must be reported within 14 days of the expected delivery date.

Failure to report claims within these timelines may result in the denial of the claim.

10. Force Majeure

Everfast Freight shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, war, strikes, civil unrest, weather conditions, pandemics, or government actions.

11. Intellectual Property

All content on this Website, including text, logos, images, and software, is the property of Everfast Freight Forwarders Pvt Ltd and is protected by Indian and international copyright laws.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the courts in Noida/Delhi.
